The article examines exclusion clauses and the application of the Unfair Terms in Consumer Contract Regulations 1999. The common law predominately dealt with exclusion clauses and to a large extent the common law is still used today to test whether or not a clause has first been incorporated, and secondly the construction of that clause, for example, does it
exclude or limit the liability in question?
